General Terms and Conditions (GTC) – ALTRA Studios e.U.

I. Scope and Contract Basis

1. These GTC apply to all services, sales, productions, rentals, and online offers provided by ALTRA Studios e.U. 

2. By using the website, placing an order, or submitting a booking through online shop systems, these terms are deemed fully accepted. 

3. Deviating terms only apply if confirmed in writing. 

4. Depending on the situation, different or restricted consumer rights (B2C) or business rights (B2B) apply according to Austrian consumer protection laws.

 

II. Offers & Conclusion of Contract

1. Offers are non-binding and valid for 12 weeks. 

2. Verbal price indications are not binding. 

3. Additional services or subsequent change requests will be charged separately. 

4. The contract is concluded only after written confirmation or actual service performance by ALTRA Studios e.U.. 

5. Webshop orders become binding upon clicking “Place binding order”.

 

III. Payment Terms

1. Payment term: 14 calendar days. 

2. For orders over € 2,000, a 50% deposit is required before project start. Production begins only after receipt of payment. 

3. In case of late payment, 8% interest will be charged. 

4. Discounts automatically expire in case of late payment. 

5. For webshop purchases: Payment is due immediately upon ordering.

6. All prices in the webshop include statutory VAT.

IV. Contract Partner and Payment Obligation

1. The contracting party is exclusively the one placing the order or releasing the budget. 

2. If intermediaries (e.g. agencies, producers) are involved, they remain jointly liable unless a direct written agreement exists with the end client. 

3. Simply forwarding communication or budgets does not constitute direct commissioning by the end customer. 

4. Transferring the payment obligation to third parties is excluded unless ALTRA Studios e.U. explicitly agrees in writing.

 

V. Right of Withdrawal and Cancellation

1. For consumers, the statutory withdrawal period is 14 days from the conclusion of the contract. 

2. For webshop orders, the statutory withdrawal period is 14 days from receipt of the goods. 

3. No right of withdrawal exists for:

   • commencement of performance or production,

   • complete delivery of produced media,

   • webshop items such as print-on-demand (prints, merchandise) and digital products (LUTs, presets).

4. Business customers (B2B) are not entitled to a right of withdrawal.

5. The withdrawal may be declared in text form (e.g., by letter or email). You may also use the [sample withdrawal form], which is not mandatory.

6. In the event of a withdrawal, the services received must be returned. You shall bear the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for examining their condition, properties, and functionality.

 

VI. Deadlines, Delivery & Cancellations

1. Delivery time for raw material: 1–3 working days after the last shooting day.

2. Delivery time for final edited media: 1–14 working days.

3. For more complex projects, processing times may vary. This will be agreed individually in advance and must remain within reasonable limits. For express processing (24 or 48 hours), a surcharge of 30% will be applied.

4. Short-notice assignments, rescheduling, or productions under significant time pressure will incur a surcharge of 30%.

5. Delays in delivery caused by technical or external factors do not justify claims for damages.

6. In adverse weather conditions, the shooting date may be postponed after consultation. If the production is nevertheless carried out, ALTRA Studios e.U. assumes no liability for quality loss.

7. If a confirmed shooting date is canceled less than 48 hours before the start, a cancellation fee of 25% will be charged.

8. If the cancellation occurs 24–48 hours before the start, the fee is 50%.

9. For cancellations less than 24 hours before the start or in case of no-show, the full amount is due.

10. For webshop orders, the following delivery terms apply: Prints (Print-on-Demand): shipping within 5–10 working days within Germany, Austria, and Switzerland, and 5–20 working days worldwide. Shipping is free of charge worldwide. Digital products (e.g., LUTs, Presets): delivered via download link after payment is received.

11. Additional import duties or customs fees incurred in the recipient country are not included in our prices and must be borne by the buyer.

 

VII. Production, Duration & Services

1. Day rates apply to 1-5 or 5-10 hours including travel and setup.

2. Additional work (overtime) will be charged at 150% of the regular hourly rate.

3. Two basic revisions are included. Further changes – particularly content restructuring, additional edits or music licensing – are considered additional services and will be billed separately. 

4. For parts of post-production (e.g. audio processing, effects, retouching, or optimization), ALTRA Studios e.U. reserves the right to use automated or AI-based systems if it benefits quality or efficiency. 

5. Responsibility for lawful use of such tools lies with ALTRA Studios e.U., unless otherwise agreed. Disclosure of tools used will be provided only upon justified request. 

6. Final media (e.g. edited videos or photos) are delivered digitally. 

7. Delivery of raw footage only occurs if explicitly agreed upon. Project files, timelines, or unprocessed FPV footage will not be shared under any circumstances. 

8. ALTRA Studios routinely archives all produced content on internal storage systems. 

9. Custom data retention or deletion requires a separate agreement. Waiving archiving does not reduce the project price.

 

VIII. Usage Rights & Copyright

1. Copyright remains with ALTRA Studios e.U.. 

2. With each project, unless otherwise agreed, an exclusive right of use including unrestricted commercial usage is granted.

3. Usage rights may be limited in duration, territory, or scope. 

4. Sub-licensing or resale to third parties is only permitted with prior written consent from ALTRA Studios. 

5. The client must refrain from any abusive or unlawful use. 

6. Modifications or edits to final works require prior written approval. 

7. Credit attribution may be required. 

8. ALTRA Studios reserves the right to use the produced material for self-promotion or competitions, regardless of the scope of the granted usage rights.

 

IX. Liability & Warranty

1. ALTRA Studios assumes no liability for damages caused by third parties, force majeure, or incorrect client information.

2. In the event of technical failures (e.g., malfunction of cameras, drones, or storage media), ALTRA Studios e.U. liability is limited to repeating the service on an alternative date, provided this is possible and reasonable. 

3. For flights with FPV drones or other high-risk shots where the client has expressly agreed to the increased risk (e.g., tight maneuvers, proximity to objects, or high-speed flying), there is no entitlement to repetition, replacement, or compensation if the shot cannot be completed as planned due to a crash or technical failure.

4. Liability – except in cases of intent or gross negligence – is limited to the agreed fee. Liability for indirect damages, consequential damages, or loss of profit is excluded.

5. No liability is accepted for KPIs, reach, revenue, or engagement metrics. 

6. For digital products, the statutory warranty provisions apply. 

7. Changes to external digital systems (e.g. third-party platforms or social media) are beyond ALTRA Studios e.U. control.

 

X. Client Obligations

1. The client ensures the shooting location is accessible, safe, and free of hazards for crew and equipment. 

2. Basic shoot preparations (e.g. key persons present, briefing, visual condition of the location) are the client's responsibility. 

3. ALTRA Studios e.U. can assist with permits (e.g. drone flights) if included in the offer. 

4. Delays or extra work due to unclear responsibilities or missing preparations will be billed according to actual time spent.

 

XI. Data Protection & Confidentiality

1. Personal data is processed exclusively for contract fulfilment and in accordance with the GDPR. 

2. Data is only shared if required to fulfil the contract or due to legal obligation.

3. Payment data may be stored via payment providers in accordance with PCI-DSS.

5. Both parties agree to maintain confidentiality regarding all non-public information, especially concerning offers, project content, communications, or business terms.

 

XII. Accounts, Access & Platform Use

1. User accounts are personal. 

2. The client is responsible for all activity on their account unless unauthorized access is proven. 

3. ALTRA Studios may temporarily or permanently restrict access in case of violations. 

4. Use of the website is at the user’s own risk – particularly regarding external links or data transmissions.

XIII. Equipment Rental

1. Rentals are available exclusively to persons of legal age (18 years or older) or to companies. ALTRA Studios e.U. reserves the right to refuse a rental at its sole discretion without providing reasons.

2. The equipment is insured. In the event of damage, the renter bears a deductible of 15% of the replacement value, at least €150. Insurance coverage applies only to damages occurring during proper use. In case of loss, theft, gross negligence, or intent, the renter is fully liable for the entire replacement value.

3. Any transfer or subletting of the equipment to third parties is strictly prohibited.

4. The agreed rental period is binding. In the case of late return, an additional daily rental fee will be charged.

5. A security deposit is generally not required. However, ALTRA Studios reserves the right to request a deposit or other security in individual cases.

6. Cancellations are free of charge up to 24 hours before the rental period starts. After that, 50% of the rental fee will be charged.

7. Equipment will only be handed over upon presentation of a valid official photo ID.

8. For identification and security purposes, a copy of the renter’s valid official photo ID will be made at the time of handover. This copy may be stored and used by ALTRA Studios e.U. for the execution of the contract as well as for potential future rentals or outstanding claims.

 

XIV. Final Provisions

1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). 

2. Jurisdiction is Salzburg, unless mandatory legal jurisdiction applies. 

3. Should individual clauses be invalid, the rest of the agreement remains in effect. 

4. Changes to these GTC will be published at www.altrastudios.com/terms.

5. The version of these Terms and Conditions valid at the time of contract conclusion shall apply.
